Terms and conditions
Carried over from komeback.com (2023 version)
These terms have been carried over from our previous website and relate to the retreats. They will be updated to cover Private Sessions, the Personal Journey and stays at Moln. This is a translation. If there is any difference between the two, the Dutch version prevails.
KOMEBACK is a trading name of BV RV-INVESTMENTS (Belgian company number 1003.178.849), whose registered office is at Slichtestraat 13, 3640 Kinrooi, Belgium. These terms and conditions form an integral part of every agreement between BV RV-INVESTMENTS and any other party (the participant).
Article 1: Booking and payment
1.1. By booking a retreat, the participant accepts these terms and conditions. The participant confirms that they have read these terms before confirming the booking, and by booking agrees to them.
1.2. A retreat can be booked in several ways (by email, through the website, etc.). Every booking creates an obligation to pay. A booking is only confirmed once KOMEBACK has received payment.
1.3. The receipted invoice is always sent by email, together with a link to these terms and conditions. Any complaint about the invoice must be made by registered post within 14 days of the invoice being sent, failing which it will not be considered.
Article 2: Distance selling
2.1. Once a retreat has been booked, the participant has no right of withdrawal and no cooling-off period. Retreats are expressly excluded from the right of withdrawal.
2.2. If the accommodation has to be changed, KOMEBACK will arrange an equivalent alternative and inform the participant. Such a change does not entitle the participant to cancel.
Article 3: Cancellation by the participant
3.1. Cancellations can only be made by email to rocco@komeback.com.
3.2. The following cancellation charges apply: if the participant cancels up to 30 calendar days before the retreat, 50% of the total price is payable. If the participant cancels less than 14 calendar days before the retreat, the full price is payable.
3.3. If the participant decides to leave during a retreat, no refund is given and the full price remains payable.
Article 4: Cancellation by KOMEBACK
If KOMEBACK cancels a retreat, the amount paid will be refunded in full. A retreat may be cancelled if there are too few participants, or because of illness, family circumstances or force majeure affecting the guides or coaches.
Article 5: Complaints
5.1. Any complaint about KOMEBACK’s services must be made in writing within 8 calendar days of the end of the retreat.
5.2. Any compensation for which KOMEBACK may be liable is limited to the total amount invoiced to the participant.
Article 6: Limitation of liability
6.1. If the participant is under medical supervision (for example, if they are required to take certain medication), they must provide explicit medical approval to take part in a retreat. If they do not, KOMEBACK accepts no liability for any medical problem that may arise afterwards.
6.2. Retreats and coaching are not intended to replace therapy or medical treatment of any kind. KOMEBACK provides its services to the best of its ability. This is an obligation of means, not of result, and KOMEBACK cannot guarantee any particular outcome.
6.3. KOMEBACK reserves the right to refuse a participant where there are good grounds for doing so.
6.4. If the participant misses all or part of the retreat, for example because of travel delays, this is entirely at their own risk and no refund will be given.
Article 7: Personal data
The participant’s personal data is handled with due care, as described in our privacy policy.
Article 8: Governing law and jurisdiction
Any dispute concerning the performance of the agreement between KOMEBACK and the participant falls under the exclusive jurisdiction of the courts of the judicial district of Limburg, Tongeren division. The agreement is governed solely by Belgian law, to the exclusion of international conventions.
